Website Build Agreement
Version 1.0 · Effective 14 August 2026 · Applies to one-time website packages and any add-ons bought with them, accepted by ticking the agreement box at checkout.
1. Parties and acceptance
This Agreement is between Elevateagency, a Maryland limited liability company trading as Elevate Agency, of Boyds, Maryland, United States (“we”, “us”), and the individual or entity placing the order (“you”). By ticking the agreement box and completing payment, you accept these terms and enter a binding contract. If you are accepting on behalf of a company, you confirm you are authorised to bind it.
2. What you are buying
Your order at checkout, meaning the package, any add-ons, and their quantities, forms the scope of work and is incorporated into this Agreement (the “Order”). Anything not listed in the Order is not included. Your Stripe receipt and order confirmation together record the Order.
3. Price, deposit and balance
Prices are in US dollars and exclude any applicable taxes. Payment is in two parts:
- a 50% deposit, charged when you place the order, which is what starts the work; and
- a 50% balance, due before your site is made live or handed over to you.
We are not obliged to launch or hand over the site until the balance clears.
4. Deposit refunds
Your deposit is refundable in full until we begin work. Once work has begun it is non-refundable, because it covers time already spent. If you cancel after work begins but before launch, you owe for work completed to that point and we will refund any excess.
5. Timeline
We aim to build and launch within two to three weeks of receiving everything we need from you. That is an estimate, not a guaranteed date. Delays caused by late content, late feedback, or waiting on third parties such as domain registrars or hosts extend it accordingly.
6. What you provide
You are responsible for supplying your content, images, logo files and any account access we need, and for giving feedback within a reasonable time. You confirm you own or are licensed to use everything you send us, and that it does not infringe anyone else rights. If a project stalls for more than 60 days waiting on you, we may close it and treat the balance as due for work completed.
7. Revisions
One round of revisions is included before launch. A round means one consolidated set of changes, not an open-ended sequence. Add-ons that state their own revision allowance, such as Logo Design which includes two rounds, are governed by that allowance. Further changes are quoted separately.
8. Domain, hosting and third-party costs
Unless your Order says otherwise, you own and pay for your domain. Your domain and existing email are not altered by us without your instruction. Hosting is covered by a care plan if you buy one; otherwise it is yours to arrange. Any third-party fee, such as a registrar, host, premium plugin licence or stock imagery, is yours unless the Order includes it.
9. Ownership
On receipt of full payment, you own the finished site: its design, content and configuration. Until then we retain ownership. This does not transfer ownership of third-party software, themes or plugins, which remain under their own licences, nor of any general tools, code libraries or techniques we use across projects. We may show the finished site in our portfolio and marketing unless you ask us in writing not to.
10. Acceptance
We will let you know when the site is ready. If you do not raise issues within 7 days of that notice, the site is treated as accepted and the balance falls due.
11. What we do not promise
We build sites; we do not control search engines, advertising platforms or customer behaviour. We make no guarantee about search rankings, traffic, enquiries, sales or revenue, and nothing we say in a consultation, proposal or marketing material should be read as one. SEO work improves how your site is structured and described; it does not buy a position on Google.
12. Legal pages add-on
If your Order includes Legal Pages and Cookie Consent, those documents are prepared from standard templates as a convenience. They are not legal advice, we are not your lawyers, and you are responsible for having them reviewed for your business and jurisdiction.
13. Liability
To the fullest extent the law allows, our total liability arising out of or relating to this Agreement is limited to the amount you have actually paid us for the Order giving rise to the claim. We are not liable for lost profits, lost data, lost business, or any indirect or consequential loss. Nothing here excludes liability that cannot lawfully be excluded.
14. Termination
Either of us may end this Agreement in writing if the other materially breaches it and does not fix the breach within 14 days of being told. On termination you pay for work completed to that date.
15. General
This Agreement, together with your Order, is the entire agreement between us and replaces anything discussed beforehand. We may update these terms for future orders; the version you accepted at checkout governs your Order. It is governed by the laws of the State of Maryland, and the courts of Maryland have exclusive jurisdiction. If any clause is unenforceable, the rest survives.
